Motorists with a blood alcohol content higher than .18% will be charged with Aggravated DWI. Aggravated DWI is a misdemeanor in New York.
Motorists charged with Aggravated DWI face penalties of:

  • A fine ranging from $1000-$2500

  • 1 year revocation of driver’s license or driving privileges in New York

  • Participation in Drinker Driver Program or Stop DWI Program

  • Court surcharges of $395

  • Up to three years probation

  • Installation of ignition interlock device on vehicle

  • Driver Responsibility Assessment of $750, which can be paid over three years

  • Attendance at a victim impact panel

  • Performance of community service
